Perfect Job Solutions ("the Company") is the owner of this web site BestJobsAfrica.com and any other site of the Company accessed through this site (collectively "Web Site") and the services provided therein shall only be available to user seeking employment ("Jobseeker") or user seeking employees or advertisers and be subject to the Privacy Policy and the Terms and Conditions (which are set out below). If you do not accept either or both thePrivacy Policy and the Terms and Conditions, please do not use the Web Site. Upon your acceptance of the Privacy Policy and the Terms and Conditions, the Terms and Conditions shall be binding upon you.
The Company may revise the Privacy Policy and the Terms and Conditions at anytime without prior notice. You are advised to periodically review thePrivacy Policy and the Terms and Conditions. Your access to the Web Site and the Company's services will be terminated upon your notice to the Company that any change is unacceptable; otherwise your continued use shall constitute your acceptance of all changes and they shall be binding upon you.
The BestJobsAfrica.com site is a public site with free access and the Company assumes no liability for the quality and genuineness of responses. Perfect Job Solutions cannot monitor the responses that a person may receive in response to information he/she has displayed on the site. The individual/company would have to conduct their/its own background checks on the bonafide nature of all response(s).
The user must be 18 years of age or older to visit or use BestJobsAfrica.com in any manner. By visiting BestJobsAfrica.com or accepting these Terms and Conditions, you represent and warrant to the Company that you are 18 years of age or older, and that you have the right, authority and capacity to use the Web Site and agree to and abide by these Terms and Conditions. You also represent and warrant to the Company that you will use BestJobsAfrica.com in a manner consistent with any and all applicable laws and regulations.
Use of BestJobsAfrica Content
The Company authorizes the user to view and access a single copy of the content available on or from BestJobsAfrica.com solely for your personal use. The contents of BestJobsAfrica.com, and of all other websites under the Company's control, whether partial or otherwise such as text, graphics, images, logos, button icons, software and other Content (collectively,  “Content”), are protected under both African and foreign copyright, trademark and other laws. All Content is the property of the Company or its content suppliers or clients. The compilation (meaning the collection, arrangement and assembly) of all content on the Web Site are the exclusive property of the Company and protected by African and international copyright laws. Unauthorized use of the Content may violate copyright, trademark, and other laws. You must retain all copyright, trademark, service mark and other proprietary notices contained in the original Content on any copy you make of the Content. You may not sell or modify the Content or reproduce, display, publicly perform, distribute, or otherwise use the Content in any way for any public or commercial purpose, in connection with products or services that are not those of the Company, in any other manner that is likely to cause confusion among consumers or that otherwise infringes the Company's intellectual property rights. The use of the Content on any other web site or in a networked computer environment for any purpose is prohibited. You shall not copy or adapt the HTML code that the Company creates to generate any Content or the pages making up any Web Site which is also protected by the Company's copyright.
Registration Information
When you register with any of the Company Web Site, you will be asked to provide the Company with certain information including, without limitation, a valid email address (your "Information"). In addition to the Terms and Conditions and any Privacy Policy applicable to any other Company Web Site, you understand and agree that the Company may disclose to third parties, on an anonymous basis, certain aggregate information contained in your registration application. The Company will not disclose to any third party your name, address, e-mail address or telephone number without your prior consent, except to the extent necessary or appropriate to comply with applicable laws or in legal proceedings where such information is relevant. 

The Company reserves the right to offer third party services and products to you based on the preferences that you identify in your registration and at any time thereafter; such offers may be made by the Company or by third parties. Please see the Company's Privacy Policy for further details regarding your Information. 

Without limiting any of the other disclaimers of warranty set forth in these Terms and Conditions, the Company does not provide or make any representation as to the quality or nature of any of the third party products or services purchased through the BestJobsAfrica.com or any other Company Site, or any other representation, warranty or guaranty. Any such undertaking, representation, warranty or guaranty would be furnished solely by the provider of the applicable class, or learning material, product or service, under the terms agreed to by the provider.
Acceptable Web Site Uses
a.     Specific Uses - Jobseeker

Jobseeker agrees that he/she shall only use the Web Site for lawful purposes and seeking employment. Jobseeker may send his/her resume directly to any Employer who advertises on or through the Web Site. Alternatively, Jobseeker may send his/her resume to the Company through the Web Site in reply to any job advertisement. In such event, Jobseeker's resume will also remain active on the Web Site and be stored in the Company's database at his/her own risk unless and until he/she chooses to delete it. Jobseeker acknowledges and agrees that his/her resume may be accessed by employer who has subscribed to the services of the Company for the sole purpose of obtaining and assessing the suitability of Jobseekers ("Employer"). The Company also reserves the right to edit any Jobseeker's resume as it sees appropriate to achieve the purpose stated herein and to erase any personal data which the Company reasonably believes that such data are inaccurate having regard to the purpose (including any directly related purpose) for which the data are or are to be used.

Jobseeker acknowledges and agrees to the Company's practice of charging Employer a fee for access to the Web Site, database ("Database") and Jobseekers’ resumes and details ("Resumes") for the sole purpose of obtaining and assessing the suitability of Jobseekers and subject to the terms herein. Jobseeker also recognizes that he/she shall have no claims to any such fee received by the Company. The Company will not release Jobseeker's personal data to any Employer without his/her permission. Jobseeker also acknowledges and agrees that the Company will release his/her brief resume (without his/her name, address and other personal identifiable information) to Employer through the use of the Company's search engine or any other means for the sole purpose of obtaining and assessing the suitability of Jobseekers in relation to any job vacancy. However, Jobseeker agrees that the Company and its associated companies may use his/her personal data (without his/her name, address and other personal identifiable information) for marketing purposes which may be directed to either potential employers or Employers, their respective agents or anyone under their employment.

The Company will not be responsible or held liable in any way if any Employer, in breach of the Terms and Conditions, whether in United Republic of Tanzania or elsewhere, use the Jobseeker's personal data for any use other than for obtaining potential employees. Jobseeker accepts that personal data given to Employer or other users are given entirely at his/her own risk. Also, the Company reserves the right to terminate any services to any Jobseeker should it become aware of any breach by any Employers and/or Jobseekers.
b.     Specific Uses - Employer

Upon payment of the service fee to the Company or upon acceptance of any free trial promotion offer, Employer will be entitled to use the Web Site to advertise job vacancies and/or create their own web page on the Web Site for a predetermined period following agreement of the predetermined service, save and except for free trial promotional offer. Employer will also be entitled to access the Database but agrees that all information obtained shall only be used for the sole purpose of obtaining and assessing the suitability of Jobseekers. Employer acknowledges and agrees that it shall disregard any personal data received from Jobseeker which are irrelevant to obtaining and assessing the suitability of candidates. Employers shall be solely responsible for the contents and materials contained in its advertisement and/or web page.

The Company reserves the right to edit any advertisement or web page as it sees appropriate to achieve the purpose stated herein. The Company shall have the right to terminate any services to any Employer and remove any advertisement posted on the Web Sites at the Company's sole discretion, without any compensation or recourse to the Advertiser in the event that the relevant Advertiser or the contents of the relevant advertisement is or are in breach of any of the provisions herein; whereas, in the event that the Company decides to remove an advertisement for any reasons not relating to any breach of the provisions herein, the Company may after deducting the fees charged for the period that the advertisement has been posted on the Web Site, refund the remaining fees (if any) to the Advertisers. The Company also reserves the right to change the service fee or institute new charges or fees, as it deems appropriate. In the event that any Employer fails to pay the service fee or any other fees or charges due to the Company, the Company reserves the right to suspend or terminate the Employer's web page or advertisement, without prejudice to all other rights and remedies.
c.     Prohibited Uses - Jobseekers and Employers

Jobseeker and Employer agree not to use the Web Site for any of the following purposes which are expressly prohibited :-
                                    i. Jobseeker shall not post any non-resume related information and/or incomplete, false or   inaccurate resume related information.
                                    ii. Jobseeker shall not respond to any employment opportunity for any reason other than to apply for the job advertised and Employer shall not respond to any Jobseeker other than in connection with his/her application for a job. Communications soliciting business for any reason is prohibited.
                                    iii. All users shall not print, download, duplicate or otherwise copy or use any personally identifiable information about other users save and except the Database or/and Resumes accessed by the Employer pursuant to Clause a. as above. All unsolicited communications of any type to users is strictly prohibited.
                                    iv. All users shall not delete or revise any material posted by any other person or entity.
                                    v. All users are prohibited from violating or attempting to violate the security of the Web Site including, without limitation, accessing data not intended for them or logging into a server or account which they are not authorised to access, attempting to probe, scan or test the vulnerability of a system or network or attempting to breach security or authentication measures without proper authorization, attempting to interfere with service to any user, host or network or sending unsolicited e-mail, including promotions and/or advertising of products or services. Violations of system or network security may result in civil and/or criminal liabilities.
                                    vi. All users shall not use the Web Site for transmitting, distributing or storing material in violation of any applicable law or regulation, or in any manner that may infringe the copyright, trademark, trade secrets or other intellectual property rights of others or violate the privacy or publicity or other personal rights of others, or that is libelous, obscene, threatening, abusive or hateful.
                                    vii. The User / subscriber / visitor to BestJobsAfrica.com or affiliated site(s) is prohibited from introducing / posting or transmitting information or software, which contains a computer virus, or a contaminant, worm or other harmful components on the internet or on BestJobsAfrica.com site or sub-domains or on any affiliate sites or any other network system.
Copyright, Trademarks etc.

The graphics, images, editorial content and HTML on the Web Site are the intellectual property of the Company and are protected by copyright and trademark laws and may not be downloaded or otherwise duplicated without the express written permission of the Company. Re-use of any of the foregoing is strictly prohibited and the Company reserves all rights.
The User is solely responsible for obtaining, at his own cost, all licenses, permits, consents, approvals and intellectual property or other rights as may be required for using the Service.
 Advertising Material
Part of the Site contains advertising/other material submitted to the Company by third parties. Responsibility for ensuring that material submitted for inclusion on the Site complies with applicable International and National law is exclusively on the advertisers and Perfect Job Solutions will not be responsible for any claim, error, omission or inaccuracy in advertising material. Perfect Job Solutions reserves the right to omit, suspend or change the position of any advertising material submitted for insertion. Acceptance of advertisements on the Site will be subject to the Company Terms and Conditions which are available on request.
Perfect Job Solutions will not be liable on account of any inaccuracy of information on this Web Site. It is the responsibility of the visitor to further research the information on the site. Any breach of privacy or of the information provided by the consumer to the Company to be placed on the website by technical or any other means is not the responsibility of Perfect Job Solutions.  The Company does not guarantee confidentiality of information provided to it by any person acquiring/using all/any information displayed on the BestJobsAfrica.com website or any of its other websites / domains owned and operated by Perfect Job Solutions.
Perfect Job Solutions shall not be liable for any loss or damage sustained by reason of any disclosure (inadvertent or otherwise) of any information concerning the user's account and / or information relating to or regarding online transactions using credit cards / debit cards and / or their verification process and particulars nor for any error, omission or inaccuracy with respect to any information so disclosed and used whether or not in pursuance of a legal process or otherwise.
The Company may not monitor its Web Site at all times but reserves the right to do so. The Company takes no responsibility whatsoever for any material input by any user or others and not posted by the Company. All users acknowledge and agree that they are fully responsible for the form, content and accuracy of any resume, advertisement, web page or material contained therein placed by them (as the case may be). The Company shall not be responsible for the content of any other web sites linked to the Web Site; links are provided as Internet navigation tools only. The Company does not warrant that any resume, advertisement or web page will be viewed by any specific number of users or that it will be viewed by any specific user. The Company shall not in any way be considered an agent of either Employer or Jobseeker with respect to any use of the Web Site. The Company shall not be responsible in any way for any decision, for whatever reason, made by any party seeking or posting jobs on the Web Site.
Own Risk
All USERS USE THE WEB SITE AND ANY OTHER WEB SITES ACCESSED THROUGH IT, AT ENTIRELY THEIR OWN RISK. All users shall be responsible for their own communications and are responsible for the consequences of their posting. The Company does not represent or guarantee the truthfulness, accuracy or reliability of any of the communications posted by other users or endorse any opinions expressed by users. Any reliance by users on material posted by other users shall be at their own risk. The Company reserves the right to expel any users and prevent their further access to the Company's Web Sites, at any time for breaching this Agreement or violating the law and also reserves the right to remove any material which is abusive, illegal, disruptive or inappropriate in the Company's sole discretion.
Registration and Password
You are responsible for maintaining the confidentiality of your account access information and passwords. You shall be responsible for all uses of your Web Site registrations and passwords, whether or not authorized by you. You are not authorized to share your password or other account access information with any other party, temporarily or permanently, and breach of this obligation may tantamount to disabling the BestJobsAfrica account and Company Services. You agree to immediately notify the Company of any unauthorized use of your Account, and passwords.
Links to Other Sites

The Web Site may contain links to third party web sites. These are provided solely as a convenience to you and not in any way as an endorsement by the Company of the contents on such third-party web sites. If users access any linked third party web sites, they do so entirely at their own risk. The Company shall not be responsible for the contents of any third party web sites linked to the Web Site and does not make any representations or warranties regarding the contents or accuracy of materials on such third-party web sites. Further any material or details posted in the Web Site by any user may be viewed by users of other web sites linked to the Web Site and the Company shall not be responsible for any improper use by any user or third party from linked third party web sites of any data or materials posted on the Web Site.
Fees and Service-Related Agreements
Payments for the services offered by BestJobsAfrica.com shall be on a 100% advance basis. Refund if any will be at the sole discretion of Perfect Solutions. The Company offers no guarantees whatsoever for the accuracy or timeliness of the refunds reaching the Customers card/bank accounts.
Perfect Job Solutions gives no guarantees of server uptime or applications working properly. All is on a best effort basis and liability is limited to refund of amount only. The Company undertakes no liability for free services. The Company reserves its right to amend / alter or change all or any disclaimers or terms of agreements at any time without any prior notice. All terms / disclaimers whether specifically mentioned or not shall be deemed to be included if any reference is made to them. 

Perfect Job Solutions further reserves its right to post the data on the website BestJobsAfrica.com or on such other affiliated sites and publications as the Company may deem fit and proper at no extra cost to the subscriber / user. 

The subscription / agreement between the Company and the subscriber / user is not a "non-poach agreement" nor can the same be termed or used as an alternative to "non-poach agreement" in as much as The Company / BestJobsAfrica.com is a public site and all information posted by the Company goes to the public domain except information / data which is specifically assigned a non-public / private character. 

Any agreement for a subscription / usage entered into by Perfect Job Solutions does not confer exclusivity of service on any subscriber / user. 

Perfect Job Solutions will not be party to any legal proceedings between a user (e.g. a subscriber) and a party contracted through the site. In case the Company is implicated in any legal proceedings, costs will be recovered from the party that names Perfect Job Solutions. Perfect Job Solutions however will abide with any court order served on it through due process. 

In case a person using the world wide web/internet receives a spam or virus which includes a link to BestJobsAfrica.com or to any other site maintained, operated or owned by Perfect Job Solutions, it should not be held responsible for the same. The Company assumes no responsibility for such mails. 

The services provided by the websites maintained, operated or owned by Perfect Job Solutions do not extend to acting as an agent (express or implied) on behalf of any subscriber or user. 

Perfect Job Solutions has no agents and does not operate through any agents save for those specifically mentioned on the home page of the website.
Force Majeure
Perfect Job Solutions shall have no liability to you for any interruption or delay in access to the Site irrespective of the cause.

All users agree to indemnify, and hold harmless the Company, its officers, directors, employees and agents from and against any claims, actions, demands, losses or damages arising from or resulting from their use of the Web Site or their breach of the terms of this Agreement. The Company shall provide prompt notice of any such claim, suit or proceeding to the relevant user.

Limitation of Liability

Without prejudice to the above and subject to the applicable laws, the aggregate liability by the Company to any user for all claims arising from their use of the Company's services and the Web Site shall be limited to the amount of the existing package fee subscribed to and paid for by the user (if any) and operative at that time.
Security Measures

The Company will use its reasonable endeavours to ensure that its officers, directors, employees, agents and/or contractors will exercise their prudence and due diligence in handling the personal data submitted by Jobseekers and the access to and processing of the personal data by such persons is on a "need-to-know" and "need-to-use" basis. The Company will use its reasonable endeavours to protect the personal data against any unauthorized or accidental access, processing or erasure of the personal data.
Anti -Spam Policy
The subscriber of the Database at BestJobsAfrica.com is subject to the Anti-Spam Policy given below:
The use and access to the Database is subject to this policy. The services provided to you are aimed at providing recruitment solutions and should be restricted to contacting suitable candidates for genuine jobs in existence. 

Mailing practices such as transmitting marketing and promotional mailers/ Offensive messages/ messages with misleading subject lines in order to intentionally obfuscate the original message, are strictly prohibited.

We reserve the right to terminate services, without prior notice, to the originator of Spam. No refund shall be admissible under such circumstances. 

Following is an illustrative (not exhaustive) list of the kinds of messages which can be classified as spam:
1.     Unsolicited Bulk Messages/Unsolicited Commercial Messages.
2.     Non Job related mails.
3.     Messages with misleading subject lines.
4.     Blank Messages.
5.     Extra ordinary High Number of mails.
6.     Mails soliciting payments.
7.     Misleading/Fraudulent mails.
Users agree to indemnify and hold harmless Perfect Job Solutions from any damages or claims arising out of usage of their user accounts for transmitting spam. Users are advised to change their passwords frequently in order to reduce the possibility of misuse of their accounts.

The Company makes no claims that the Content may be lawfully viewed or accessed outside of United Republic of Tanzania. Access to the Content may not be legal by certain persons or in certain countries. Your access to Perfect Job Solutions sites is at your own risk and you are responsible for compliance with the laws of respective State's jurisdiction as may be applicable to you. These Terms and Conditions are governed by the internal substantive laws of the Mwanza, United Republic of Tanzania without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts within Mwanza, United Republic of Tanzania.
If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any term of these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term. Except as expressly provided in an additional agreement, additional terms of use for areas of BestJobsAfrica.com, a particular "Legal Notice," or Software License or material on particular Web pages, these Terms and Conditions constitute the entire agreement between you and the Company with respect to the use of BestJobsAfrica.com. No changes to these Terms and Conditions shall be made except by a revised posting on this page.
